11th Circuit Affirms District Court’s Approval of the BCBSA $2.67 Billion Settlement

On October 25, 2023, the U.S. Court of Appeals for the 11th Circuit affirmed a district court’s approval of the $2.67 billion class action settlement reached by the Blue Cross Blue Shield Association (“BCBSA”) and the class plaintiffs. In this recent decision, the 11th Circuit affirmed the earlier approval by a district court of both the $2.67 billion settlement and the injunctive relief measures included in the agreement.

USCIS Issues Favorable Proposed Rule on the H-1B Specialty Occupation Worker Program

The U.S. Citizenship and Immigration Services (“USCIS”) recently issued a Notice of Proposed Rulemaking (“NPRM”) relating to the H-1B nonimmigrant visa classification. The proposed rule intends to streamline H-1B eligibility requirements, provide greater benefits and flexibilities to employers and workers, and strengthen integrity measures of the program by clarifying and codifying existing policies and making changes to the H-1B registration process.

Right to Work Repeal Will Go Into Effect February 12, 2024

On Thursday the Michigan legislature decided to adjourn for this year early, passing a resolution that sets the official “sine die” adjournment date for Tuesday, November 14.

As a result, any new legislation signed by Governor Whitmer this term that was passed without immediate effect will become effective on February 12, 2024—90 days following adjournment.

The IRS recently released inflation-adjusted limitations that apply to various employee benefits in 2024. REMINDER: EEO-1 Filing Opens Today

As noted in our September 5 client alert, the Equal Employment Opportunity Commission (EEOC) announced that the 2022 EEO-1 Component 1 data collection will open on October 31, 2023.  The deadline for employers to file their EEO-1 reports is December 5, 2023.

School Retiree Changes Head to Governor’s Desk

On September 28, 2023, the Michigan Legislature sent additional school retiree reforms to Governor Whitmer’s desk. House Bill 4752 looks to strike a middle ground between the old retirement regime and the nine-month waiting period enacted in 2022, and Governor Whitmer is expected to sign the bill into law.

New Cannabis Policy Takes Effect October 1st

Earlier this year, the Michigan Civil Service Commission unanimously agreed to remove marijuana from the pre-employment drug testing protocols.
