OFCCP Publishes Second CSAL for 2023

Late last week the Office of Federal Contract Compliance Programs (OFCCP) released the second Corporate Scheduling Announcement List (CSAL) for 2023.  The CSAL is advance notice to a federal contractor establishment selected for a Compliance Review (Establishment Review), Corporate Management Compliance Evaluation (CMCE), or Functional Affirmative Action Program (FAAP) Review.

The most recent CSAL includes approximately 1,000 supply and service contractors.  Although the CSAL provides advance notice to contractors that they will be audited, audits do not actually start until the contractor receives a Scheduling Letter.

Under OFCCP’s current policy, Scheduling Letters may be issued immediately, so contractors should review the new list to see if they’ve been selected for an audit and if so begin preparing immediately.

OFCCP recently received approval from the Office of Management and Budget for a revised scheduling letter and itemized listing that will make compliance reviews significantly more burdensome for federal contractors.  This second CSAL for 2023 will be the first to use the new scheduling letter.

Please contact the authors of this client alert if you would like assistance preparing for an audit or have questions about this topic.
