EEO-1 Report Filing Portal Now Open

As summarized in our January and March Alerts, the EEOC’s online portal for filing the annual EEO-1 Report is now open for submission of workforce data.  The online filing portal will remain open for 12 weeks, until the deadline of July 19, 2021.  The following are key points for this year’s EEO-1 Report program:

  • Covered employers that must submit an EEO-1 Report are private sector businesses with at least 100 employees, and federal government contractors with at least 50 employees.
  • Employers must report the total number of employees in various EEO occupational categories (e.g., professionals, technicians, administrative support, operatives, laborers and so on), by race/ethnicity and sex.
  • This report has come be known as EEO-1 “Component 1,” to distinguish from the reporting of pay and aggregate hours worked data two years ago – which was called “Component 2”. Component 2 was abandoned by EEOC last year after only a single data collection.
  • Covered employers must report workforce data for both 2019 and 2020. EEOC skipped the EEO-1 Report last year because of national employer turmoil caused by COVID-19.
  • Employers must take a “snapshot” of their workforce from any single pay period in the 4th Quarter (October – December) of 2019 and 2020 for determining which employees to report on their EEO-1 Reports for each respective year.
  • Multi-establishment employers must file a separate EEO-1 Report for the headquarters / principal place of business, and for any establishment with at least 50 employees.
  • EEOC has already mailed notification letters to previous filers for whom the agency has contact names and addresses. Any covered employer that has not received a notice letter (or perhaps mail delivery has been interrupted due to remote work arrangements) must contact the EEOC at FilerSupport@eeocdata.org for assistance.  A new user ID and new passcode is required; it was provided in the notice letter or is available from EEOC.
  • The online form is available for submission now through July 19. EEOC has announced that larger information reporting via data file upload will not be available until May 26, 2021.

For organizations that file other types of EEO reports, the agency has announced the following opening dates:

July 2021:       EEO-5 Data Collection (Public Elementary/Secondary School Districts)
August 2021:   EEO-3 Data Collection (Local Unions)
October 2021: EEO-4 Data Collection (State/Local Governments)
