Section 31aa Update

In the evening of October 30, 2025, the Michigan Department of Education (“MDE”) noted a correction in “the deadline for the Per Pupil Mental Health and School Safety – Section 31aa grant” stating that the correct deadline date to accept funding under Section 31aa for mental health and school safety is November 30, 2025.

The Trump administration announced two major changes to employment-based immigration to the United States. The first provides guidance on the administration’s recently announced fee affecting new H-1b visa applications. The second creates a new category of employment-based permanent residence for those who are willing and able to give the United States a substantial gift.

Section 31aa Funding Alert

Each year, the State School Aid Act sets expectations with respect to school compliance by establishing various requirements for school districts to be eligible for various sources of funding.  For the fifth consecutive year, the Legislature saw fit to provide additional funding (estimated at $140/pupil) for school safety purposes.

USPTO Issues New Guidance on Section 101 Eligibility

The USPTO recently issued new guidance on evaluating subject matter eligibility under Section 101. Although it does not expressly change the Office’s prior guidance, it reinforces several important points. The preponderance-of-the-evidence (i.e., >50%) standard for § 101 rejections. New MDE Guidance: Students with Attendance Issues and Child Find Obligations

The Michigan Department of Education, Office of Special Education, released new guidance in August 2025 regarding providing attendance support to students with disabilities.  This guidance emphasizes that areas involving attendance may impede students with disabilities access to education.  Specifically, special education students served by the Individuals with Disabilities Education Act (“IDEA”) experience higher rates of chronic absenteeism.

Signals from the Sixth Circuit- Protecting Privilege for Internal Investigations

Yesterday, the United States Court of Appeals for the Sixth Circuit issued an order in In re FirstEnergy Corp. (No. 24-3654), suggesting that the Court is leaning toward strong protections against disclosure for documents and other materials generated during an organization’s internal investigation. The Court granted an emergency motion to stay a district court discovery ruling that would have compelled production of the company’s internal investigation files. This decision offers a strong signal that the Sixth Circuit is considering a more favorable rule for preserving the attorney-client privilege and work-product protection in the context of internal investigations.
