President Biden Announces Private Health Plans to be Required to Cover At-Home COVID-19 Tests

On December 2, 2021, as part of a larger announcement on President Biden’s winter plan to combat COVID-19, President Biden announced that private health plans will be required to cover the cost of at-home COVID-19 tests.  The Departments of Health and Human Services, Labor and Treasury are expected to issue guidance by January 15, 2022 implementing the new requirement.  According to President Biden’s announcement, the new requirement will apply to “private” group health plans and health insurers.  It is unclear whether the requirement will apply to health plans sponsored by governmental employers, but it does not appear to apply to government programs such as Medicare and Medicaid. We will publish another client alert when the new federal guidance is issued.
