FinCEN Announces Filing Relief for Reporting Companies Impacted by Hurricane Helene

On 10/29/2024, FinCEN extended the deadline for victims of Hurricane Helene to submit benefit ownership information (“BOI”) reports. If both of these conditions apply (1) the deadline for the reporting company to file an initial or updated BOI report falls on or between 9/22/2024 – 12/21/2024 and (2) the reporting company has its principal place of business in an area designated both by FEMA as qualifying for individual or public assistance, and by IRS as eligible for tax filing relief as a result of a disaster caused by Hurricane Helene (including disasters caused by Tropical Storm Helene), you have an additional six months to submit BOI reports (including updates or corrections to prior reports).

For example, if your company’s initial BOI report is originally due on 10/23/2024, and the company has its principal place of business in an area designated both by FEMA as qualifying for individual or public assistance and by the IRS as eligible for tax filing relief as a result of Hurricane Helene, the company’s initial BOI report is now instead due by 4/23/2025.
