New York District Court Turns Back Challenge to New Title IX Regulations


 

The State of New York and the City School District of New York filed a lawsuit in the United States District Court for the Southern District of New York challenging the new Title IX regulations on a wide variety of procedural and substantive grounds.  For relief, plaintiffs sought a preliminary injunction, preventing the enforcement of the new regulations or, alternatively, staying their implementation pending the outcome of the lawsuit.  Judge John G. Koeltl, a Clinton appointee, issued a 46 page opinion considering plaintiffs arguments and denying their request.  State of New York, et al. v United States Department of Education, et al., Case No 20-CV-4260 (August 9, 2020).  This is but one of several similar pending cases.
