Labor Update: Union Efforts On The Rise and Employer Speech Rights Under Attack

The labor law world is changing . . . and it’s starting to happen quickly.   Is your organization ready?

Unionization efforts are on the rise.  Amazon warehouse workers recently voted in favor of a homegrown union at one of the retail giant’s New York distribution centers—the first successful campaign against the company.  That news came on the heels of a contested union re-run election in Alabama.  Similarly, Starbucks has become unionized in Buffalo, New York and is fighting union organizing drives at various locations across the country.

And government is committed to helping them.  Just last Thursday, consistent with President Biden’s promise to be the most pro-union President ever, the NLRB’s General Counsel announced a seismic shift in employer free speech rights—one that will significantly impair and restrict how and when employers are permitted to communicate with their employees about union issues (or other protected matters) during worktime.   Indeed, the General Counsel’s April 7 memo announces a departure from 78 years of settled law in how employers may lawfully address these important matters with their employees.
