Employee Benefits Litigation Update

Plaintiffs continue to target employers using novel theories to challenge settled practices. Jeff Gray will cover the latest developments, including pension risk transfers, use of retirement plan forfeitures, mortality assumptions in defined benefit plans, the constant lawsuits against 401(k) and 403(b) plan fiduciaries related to investment performance and fees, and the expansion of 401(k)-style fee litigation into health and welfare plans. Jeff will discuss the main takeaways from these cases and offer some suggestions to mitigate risk.
