Many employers maintain 401(k) or 403(b) plans to assist their employees in saving for retirement. But despite their popularity, the administration of 401(k) plans is not simple. There are many “traps” for the unwary and getting it wrong can have serious legal ramifications.
In part one, on February 16, Jim Bruinsma and Jeff Gray will provide information about rules that apply to 401(k) plans, plan design choices for employers, common errors that occur in plan administration, and IRS/DOL correction programs. Much of the information will also apply to section 403(b) programs.
In part two, on May 18, Jim Bruinsma and Jeff Gray will provide information relating to fiduciary responsibility. There have been numerous lawsuits filed against plan fiduciaries alleging that they breached their fiduciary duties. One of those costs was just decided by the U.S. Supreme Court. What can fiduciaries do to minimize their risk?
