On December 2, 2021, President Biden announced that health plans, including employer-sponsored group health plans, will be required to cover certain at-home COVID-19 tests. On Monday, January 10, 2022, the Departments of Health and Human Services, Labor, and Treasury (the “Departments”) issued additional guidance on this requirement to cover at-home COVID-19 tests in the form of FAQs. Notably, the Departments’ guidance indicated that health plans must begin covering at least 8 at-home COVID-19 tests per participant per month beginning on or after January 15, 2022.
