Deadline Extended for Michigan Public Schools to Participate in Proposed IRS Closing Agreement on 3% Retiree Healthcare Contributions


In a previous communication, clients were notified of an upcoming deadline relative to the opportunity to participate in a proposed IRS closing agreement for 3% retiree healthcare contributions.  The substance of the issue was summarized on Miller Johnson’s Education Law Blog and is accessible for review here.

Miller Johnson has now received information from the State of Michigan Office of Retirement Services (“ORS”) confirming that the February 5, 2021 deadline to submit Form 2848 to ORS to opt into the IRS closing agreement has been extended.  In an effort to accommodate school districts that wish to have their boards officially determine whether to take advantage of the closing agreement, the new deadline is March 1, 2021.  ORS also confirmed that it will cover the $3,000 fee to enter into the closing agreement.
