Nicholas Wheeler is an Associate of the firm and has been practicing law since 2019.  His practice areas include utility patents, design patents, intellectual property licensing, trademark litigation, cybersquatting, and copyright litigation.  Nick’s practice is primarily focused on patent litigation and has represented clients in matters and proceedings in United States federal district courts, the International Trade Commission, and the Patent Trial and Appeal Board.

Nick works with a broad range of clients and has played a significant role within multiple patent litigations, including assisting in managing discovery, authoring non-dispositive motions, taking and defending expert and fact depositions, and drafting summary judgment motions. 

Nick’s experience includes:

• Represented a Fortune 250 company in the district court and ITC in multiple multi-design patent litigation matters.
• Represented a Fortune 250 company in pre-suit matters such as successfully responding to cease and desist letters and responding to third party subpoenas.
• Represented a security software company in litigation before the Patent Trial and Appeal Board.  Obtained a favorable settlement. 
• Obtained favorable settlements for filmmakers in copyright litigation matters regarding royalties, attribution, and derivative works.  
• Represented automobile certification company in a design patent district court matter.  
• Obtained favorable settlements for photographers in copyright litigation matters.
• Obtained a favorable settlement for an author in a copyright litigation matter regarding attribution and breach of contract.
• Obtained a favorable settlement for a musician in a trademark litigation matter regarding domain names, merchandise, and social media pages.

Nick has been named one of Super Lawyer’s “Rising Stars” and Best Lawyer’s “Ones to Watch” since 2024.  These accolades are awarded to lawyers who have demonstrated various achievements in their practice area, extensive recognition from their peers, and has exhibited attributes which set them apart from other lawyers.

Education

Nick received his law degree in 2019 from the Indiana University Maurer School of Law and his undergraduate degree in General Engineering with a minor in Business in 2016 from the University of Illinois at Urbana-Champaign.
