Dan Perk is a Member of the firm and has been practicing law since 1985.  His practice areas include general commercial litigation, construction litigation, tax appeal/tax tribunal litigation, real estate litigation and immigration law.  Industries that he works with include manufacturing, construction, real estate, and nonprofits as well as various business owners and individuals.

Tax Appeal / Tax Tribunal
Mr. Perk works with a wide variety of taxpayers including non-profit organizations, manufacturing companies, commercial real estate groups, business and farming entities.  Tax law is subject to constant revisions and has become more challenging.  He keeps abreast of these changes and developments to counsel his clients.  Mr. Perk has handled an extensive range of appeals and disputes before the Michigan Tax Tribunal, State Tax Commission, and local boards of review.  Among the matters handled are:

  • Commercial valuation disputes including multi-tenant housing, office complexes, medical offices, and retail centers/malls
  • Industrial valuation disputes involving manufacturing facilities
  • Tax exemption disputes including hospital/public health exemption, charitable institution exemption, education exemption, elderly housing exemption, and principal residence exemption
  • “Transfer of ownership” and uncapping issues
  • Property classification disputes

Construction Litigation
Mr. Perk has represented owners, developers, contractors and subcontractors in prosecuting and defending a wide range of construction disputes.  He has significant experience in handling those specialized and unique construction matters related to government financed projects such as those by the Michigan State Housing Development Authority (MSHDA).  He has also handled cases related to construction of schools.

Mr. Perk is experienced at handling matters related to construction claims including poor workmanship, delay claims, work not performed and additional costs.

General Commercial Litigation and Real Estate Litigation
Mr. Perk has a diverse litigation practice and regularly handles a wide variety of general commercial and real estate cases at the trial and appellate levels, in state and federal courts in Michigan.  Some examples of recent cases are non-competition and trade-secret actions, condemnation actions, environmental litigation, insurance coverage disputes, product liability claims, partnership and shareholder disputes, and civil fraud and contract actions.

Immigration
Mr. Perk has experience preparing various types of family and employment-based visa petitions, including H visas, B visas, K visas, and L-1 visas for international intra-company transfers.  He also has experience preparing “Schengen Visas” and other short term work-related visas for U.S. employees traveling to foreign countries.  Mr. Perk has also prepared naturalization applications.

Professional Affiliations, Activities and Honors
Mr. Perk is licensed to practice in the State of Michigan and admitted to practice before the U.S. 6th Circuit Court of Appeals, the Michigan Supreme Court, and the State and Federal Courts of Michigan as well as the Michigan Tax Tribunal. He belongs to the Federal Bar Association, American Bar Association – where he is a Fellow, the State Bar of Michigan, Grand Rapids Bar Association, the Kalamazoo County Bar Association and the American Immigration Lawyers Association. He is actively involved in the Pro Bono Program in Kalamazoo, Michigan. He was a Law Clerk for the Honorable Albert J. Engel, U.S. Court of Appeals, Sixth Circuit Court.

Education
Mr. Perk received his undergraduate degree in 1981 from University of North Carolina and his law degree in 1985 magna cum laude from Wayne State University Law School.  He is a member of the Order of the Coif at Wayne State University Law School and was Editor-in-Chief of the Wayne Law Review.
