Workshop

Employment Record Keeping and Personnel Files

This workshop provides an in-depth overview of the complex world of the most common employment-related records that must be maintained and reported by employers, the laws that govern employment record keeping, and advice on managing, organizing, retaining and disclosing those records in what format and for how long. There will also be in-depth coverage of personnel records/files and paper vs. electronic storage and retrieval. The workshop will also cover a wide variety of reports that must be maintained and/or submitted to government enforcement agencies. This workshop is a must for all human resources members, especially those new to the profession or responsible for record keeping, reporting and processing. Extensive written resource materials will be provided.

We will help you answer the following questions and many more:

  • How do you best organize personnel records and what documents should not be in a personnel file?
  • What is the best way to respond to employees’ and former employees’ requests for their personnel files, and how soon do you have to permit a review and provide copies?
  • Do employment records have to be kept in paper format, or can they be scanned and stored electronically?
  • What are the legal requirements for record retention and how long should you really keep personnel files and other employment records?
  • What specific EEO/employment posters must be maintained, and what has changed recently?
  • Who has to file an EEO-1 Report, how do you do it, and what changes have been made to EEO-1 Report filing?
  • What records and reports do federal contractors have to maintain and file with the government? What about applicant tracking? VETS 4212?
  • What is the best way to maintain and store I-9 Forms, and how long do you have to keep them?
  • What is the impact of medical confidentiality rules on ADA, FMLA, MIOSHA and workers’ compensation records?
  • What is Michigan’s New Hire Reporting Law and how do you comply with it?
  • What documents come into play in conducting applicant background checks and hiring?
