FLSA: Exemptions, Worktime, and Other Challenging FLSA Issues

It has never been more important to be up-to-date on wage and hour matters. In President Obama’s final year in office, we saw a continued increase in wage and hour audits by the DOL, as well as a significant increase in lawsuits by individuals and groups claiming unpaid wages and overtime pay. In addition, the recent controversy over the new white-collar regulations has drawn many employees’ attention to the issue of employee misclassification for the first time, which is an area of frequent liability for employers. Therefore, employers should make every effort to educate themselves and their human resources department regarding wage and hour law.

This workshop will help you to confidently identify, repair, and prevent common problem areas that have created serious risks for so many employers. During this workshop we will cover topics such as:

  • When are “independent contractors,” “volunteers,” and “interns” really “employees”?
  • How do we know when an employee is “exempt” from overtime pay?
  • When is it permissible to make deductions from an exempt employee’s salary?
  • Are we correctly recording time that’s “off the clock”?
  • Does pay begin when the employee punches in, or when the shift begins?
  • When are employees entitled to be paid for time spent traveling?
  • What are the requirements for giving breaks to nursing mothers?
  • Is it unlawful to make an employment decision based on the employee’s internal complaint about wage and hour practices?
